Service Partner Plan Coverage
HVAC, Residential Water Heater and Main Panel Box

Thank you for enrolling in your Weltman Home Services Limited Lifetime Warranty program. Proper maintenance of your new system is crucial to allow it to continue to operate at peak efficiency.

Terms:

This agreement is between Weltman Home Services, Inc. (“WHS”) and the participant in the SPP (“Participant”) and applies to the Participant’s residential type natural gas HVAC and/or Hot Water Heater and Electric Panel Boxes. (“Covered Equipment”)

WHS warrants that, subject to the limitations and exclusions stated hereinbelow, WHS will provide routine maintenance and repairs to Covered Equipment, including the repair or replacement of parts and components that become defective or inoperable as a result from normal wear and tear for 5 (five) years from date of initial installation, providing your Service Partner Plan is current and enforce.

Limitations:

WHS will not be responsible for damage to Covered Equipment caused by fire; flood; electric surge; power outage; freezing; vandalism; negligence; unintended use, failure of the Participant to comply with the provisions of the owner’s manual; service, installation of a replacement part, or removal of a defective part by someone other than a technician provided by WHS; faulty design; acts of nature; or any other condition beyond the control of WHS.

Should WHS determine that (i) a part or component of the Covered Equipment is obsolete or discontinued, and there are no reasonably available alternate or interchangeable parts, or (ii) the Covered Equipment is beyond its useful life; or (iii) the repair costs would be greater than the original value of the Covered Equipment, WHS reserves the right to deny coverage. System replacement will be deemed necessary in any such circumstance. System replacement is not covered under this service contract and is not otherwise included in your warranty.

Trim parts, exterior housing, and upgraded components are excluded from coverage hereunder.

Batteries are not covered under this warranty.

Pilot ignition devices, including but not limited to, glow plugs, ignitors, thermo couplings, are not covered under this warranty.

WHS reserves the right to use refurbished, reconditioned, or non-original manufacturer’s parts.

WHS reserves the right to provide service through a third-party subcontractor.

The Participant’s primary source of relief shall be the manufacturer’s warranty coverage (prior to the expiration of the manufacturer’s warranty term.)

The Participant must provide reasonable and safe access to the service area, including restraining of pets, and removal of snow and ice from walkways, shrubs, trees, insects, debris and any other obstacle that would prohibit safe and ready access to the work area.

Requests for service, other than periodic maintenance, will generally be provided within 48 hours. WHS will handle all service requests in the order in which they are received. Appointment times are not guaranteed. Weather extremes, call volumes, and other circumstances beyond the control of WHS may delay scheduling of service visits.

Routine/Periodic Maintenance:
Routine maintenance and inspections are provided only per manufacturer’s recommended intervals.

WHS shall attempt to contact the Participant to schedule periodic maintenance.

In the event that WHS is not able to reach the Participant, it is recommended that the Participant respond to WHS’s scheduling requests. Failure to schedule timely periodic maintenance may void the Participant’s warranty.

In the event of extreme weather, it may be necessary for WHS to reschedule periodic maintenance on short notice.

Before You Call:

  • Make sure power is on to home and appurtenances, and that all switches serving the Covered Equipment are in the “on” position.
  • Water Boilers: Make sure you can see the water level in the gauge glass.
  • Make sure all walkways and access areas and service area are clear of obstructions and debris and well-lit.
  • Secure all pets away from work area.
  • The Participant, or an authorized representative of The Participant, at or above legal age, must be at the premises, able to authorize repairs or replacements.

Nuisance Calls:

Service requests that are deemed nuisance calls will be chargeable at the then applicable WHS service call fee rate.

Examples of nuisance calls include, but are not limited to,

  • Service calls for which it is determined that the Covered Equipment has failed to operate due to the power switch having been turned off.
  • Service calls for which it is determined that the Covered Equipment has failed to operate due to an interruption of natural gas service.
  • Service calls for which it is determined that the Covered Equipment requires repair or maintenance as a result of repairs or maintenance performed by anyone other than WHS or a WHS provided third-party contractor.

General Exclusions:

  • General exclusions include, but are not limited to:
  • Replacing filters
  • Replacing batteries
  • Balancing of ductwork
  • Balancing of steam radiators
  • Purging air from hot water heat systems.
  • Power surges or outages.
  • Cleaning of chimney
  • Flooding or water damage due to excessive weather, mechanical breakdowns or act of nature.
  • Any preventative or routine maintenance as required by the equipment manufacturer.
  • Any repairs due to negligence, vandalism, theft, misuse, fire, freezing conditions, floods, acts of nature or any other conditions beyond the control of WHS
  • Appearance of trim parts, finish defects, surface rust,
  • Parts no longer available and for which no reasonable alternative exists.

HVAC Maintenance:

All SPP covered equipment, components and systems must be maintained by WHS for the home owner within the limits of the manufacturer’s recommended intervals. Certain portions of this maintenance is not included under the SPP and is chargeable to the SPP holder in order to maintain peak efficiency of your heating and cooling system.

Failure to properly maintain your system to manufacturer’s recommended specifications may result in warranty cancellation.

Any repairs deemed necessary due to lack of maintenance on the homeowner’s part is chargeable.

Specific Exclusions:

HVAC Heating and Cooling Systems

  • Pressure cleaning of outdoor condenser or indoor coil unit.
  • Clearing of blocked or clogged condensate lines.
  • Contactor or capacitor located at outdoor condenser unit.
  • Batteries of any type.
  • Filter replacement of any type.
  • Duct cleaning
  • Humidifier pads of any type.
  • Ignitors or glow plugs of any type
  • Condensate drain blockages of any type
  • Chimney cleaning, lining or leakage, of any type.
  • Rodent or bird intrusion into the system.
  • Power outages, or repairs caused by power outages, whether due to utility power grid or human error (switch turned off)

Steam Heat:

  • Flooding of boiler due to mechanical failure or human error.
  • Ignitors or glow plugs of any type.
  • Noise due to pipe expansion.
  • Condensate drain blockages of any type
  • Chimney cleaning, lining or leakage, of any type.
  • Batteries of any type,
  • Power outages, or repairs caused by power outages or power surges, whether due to utility power grid or human error (switch turned off)

Hydronic Heat:

  • Ignitors or glow plugs of any type
  • Purging of air from system.
  • Noise due to pipe expansion.
  • Condensate drain blockages of any type
  • Chimney cleaning, lining or leakage, of any type.
  • Batteries of any type.
  • Repairs due to excessive water pressure.
  • Power outages, or repairs caused by power outages or power surges, whether due to utility power grid or human error (switch turned off)
  • Cleaning of passageways on ultra-high efficiency system

Ductless Split / Mini Split Systems:

  • Ignitors or glow plugs of any type
  • Cleaning of condenser unit or coils.
  • Condensate drain blockages of any type
  • Batteries of any type.
  • Power outages, or repairs caused by power outages or power surges, whether due to utility power grid or human error (switch turned off)

Water Heaters:

  • Ignitors, thermo couplings or glow plugs of any type
  • Purging of air from system.
  • Dip tube corrosion.
  • Noise due to pipe expansion.
  • Condensate drain blockages of any type
  • Chimney cleaning, lining or leakage, of any type.
  • Batteries of any type.
  • Automatic shut off devices.
  • Any repairs caused by excessive water pressure.
  • Power outages, or repairs caused by power outages or power surges, whether due to utility power grid or human error (switch turned off)

Electric Panels and/or Sub Panel:

  • Power outages, or repairs caused by power outages or power surges, whether due to utility power grid or human error (switch turned off)
  • Repairs or power surges due to stand by generator usage or transfer switch usage.

Transferability:

The SPP is non- transferable. SPP coverage is valid for the original owner of the Covered Equipment, and his/her spouse, only.

Coverage Payments:

WHS reserves the right to increase the monthly fee for the SPP, based on changes in the provider’s operating costs and prevailing rates.

Payments are made monthly and automatically via credit card charge or ACH transfer.

The SPP will remain active, provided the Participant’s account remains in good standing, Failure to provide timely payment of the monthly fee will result in cancellation of the Participant’s SPP enrollment.

Participant’s Termination of SPP Coverage:

The Participant can terminate coverage by notifying WHS in writing by regular mail. Termination of coverage will be effective on the date which is thirty [30] days following WHS’s receipt of such written notice.

Exclusion of Warranties and Limitations of Damages:

WHS MAKES NO OTHER IMPLIED OR EXPRESSED WARRANTIES OR GUARANTEES OF ANY KIND. ANY IMPLIED WARRANTIES OR GUARANTEES ARE SPECIFICALLY DISCLAIMED. UNDER NO CIRCUMSTANCES SHALL WHS BE LIABLE FOR ANY LOSSES OR DAMAGES OF ANY KIND, RESULTING FROM THE FAILURE OR INOPERABILITY OF COVERED EQUIPMENT, IN EXCESS OF THE PAYMENTS RECEIVED BY WHS UNDER THIS AGREEMENT. WHS SHALL NOT BE LIABLE FOR ANY DAMAGES OR HARM TO PERSONS OR PROPERTY CAUSED BY DELAYS, FAILURE OF SERVICE, MALFUNCTIONING OF THE COVERED EQUIPMENT, UNAVAILABILITY OF PARTS, LABOR DIFFICULTIES, ACTS OF NATURE, OR OTHER CONDITIONS BEYOND THE CONTROL OF WHS. IN NO EVENT SHALL WHS BE LIABLE FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES.

Obligations of the provider under this service contract are backed by the full faith and credit of the provider.
